In order to identify the crime and its perpetrator and to collect the evidence related to the crime, law enforcement officers may operate by posing as a buyer or by acting as an ordinary person. The Court of Cassation refers to such persons as judicial law enforcement officers who conduct confidential investigations. The conditions under which such activities of law enforcement officers will be accepted, whether the evidence they obtain can be used, and whether they can be punished when they incite or encourage people to commit crimes are tried to be determined in doctrine and practice and cause discussions.In this study, the above-mentioned issues will be explained within the framework of the decisions of the Constitutional Court and the European Court of Human Rights.
